1. Updates to the Terms of Service

We may update these Terms of Service from time to time to reflect changes in legal, regulatory, or operational requirements, our practices, and other factors. Please review these Terms of Service periodically to stay informed. If you cannot accept such modifications, please cease all interactions with us immediately. We will notify you of updates to the Terms of Service as required by applicable law. Any modifications to these Terms of Service shall become effective upon the posting of the revised version (or as otherwise specified at the time of posting). In all cases, your continued use of our services after the effective date of any modified Terms of Service constitutes your acknowledgment and agreement to such terms.

2. Agreement to Terms

This Terms of Use Agreement (the “Agreement”) is a legally binding contract between you and InStory (“Company,” “we,” “us,” or “our”). This Agreement applies to your access to and use of the InStory interactive short-drama app and website (the “Service”).

[SPECIAL NOTICE] THE “ARBITRATION AND CLASS ACTION WAIVER” SECTION OF THIS AGREEMENT CONTAINS AN ARBITRATION CLAUSE AND A CLASS ACTION WAIVER. BY AGREEING TO THESE TERMS, YOU AGREE TO WAIVE YOUR RIGHT TO A TRIAL BY JUDGE OR JURY AND WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION.

3. Acceptance and Eligibility

By registering for, logging into, or using the Service, you acknowledge that you have read, understood, and agree to be bound by all terms of this Agreement. You must be at least 13 years of age to access the Service. If you have not reached the legal age of majority in your country of residence, your parent or guardian must agree to this Agreement on your behalf. If you do not agree to any part of this Agreement, please stop using the Service immediately.

4. Description of InStory Services

InStory is an interactive short-drama app. You watch short dramas in which your choices reshape the storyline, the relationships and the ending, and you can continue conversations with characters after a story concludes. InStory reserves the right to modify, suspend, or terminate all or part of the services at any time without prior notice. You agree that InStory shall not be liable to you or any third party for any modification, suspension, or termination of the services. To ensure proper use of the services, you may be required to update the app or third-party software from time to time.

Conversations with characters are generated or assisted by artificial intelligence. You acknowledge that such content may be imperfect or inaccurate, that characters are fictional, and that InStory makes no warranties about the accuracy or quality of AI-generated content.

5. User Content and Licensing

The dramas, scripts, video, characters and artwork made available through the Service are owned by InStory or its licensors. Subject to this Agreement, we grant you a limited, personal, non-exclusive, non-transferable and revocable licence to stream and view that content for your own non-commercial entertainment. You may not download, copy, redistribute, publicly perform or create derivative works from it without our prior written permission.

You retain ownership of the content you provide to the Service, including the choices you make, the messages you send to characters, and any comments or ratings you post (collectively, “User Content”). By using the Service, you grant InStory a perpetual, worldwide, royalty-free license to host, use, and reproduce your User Content solely for the purposes of operating, promoting, and improving the Service (including the training and optimization of our AI models).

6. User Conduct and Restrictions

You are permitted to use the Service only for lawful purposes and in accordance with this Agreement. You agree not to:

• Generate or distribute any content that is illegal, harmful, abusive, defamatory, obscene, or otherwise objectionable.
• Attempt to reverse engineer, decompile, or disassemble any part of the Service.
• Use any automated system (including bots, spiders, or scrapers) to access the website or Service.
• Engage in any activity that interferes with or disrupts the Service or the servers and networks connected to the Service.
• Record, rip, mirror or otherwise redistribute drama content, or use the Service to infringe upon the intellectual property rights of others.

7. Purchases and Subscriptions

Certain episodes and features are available only through in-app purchases, coin packs or paid subscription plans. By subscribing, you agree to pay all applicable fees in advance on a recurring basis. Subscriptions will automatically renew for the original term unless you cancel the plan before the end of the current billing cycle. Except as otherwise provided by law, all fees paid are non-refundable, and virtual items such as coins have no cash value.

Purchases made through the Google Play Store or the Apple App Store are also subject to the terms of the applicable app store, including its refund policy.

8. Intellectual Property

The Service (including its proprietary algorithms, graphical interfaces, and “look and feel”) is protected by copyright and trademark laws and remains the exclusive property of InStory and its licensors. The InStory name and logo are trademarks of the Company and may not be used without our prior written permission.

9. Disclaimer of Warranties

YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. INSTORY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, INSTORY ENTITIES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES. THE TOTAL LIABILITY OF INSTORY TO YOU FOR ANY CLAIM UNDER THIS AGREEMENT SHALL NOT EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE TOTAL AMOUNT YOU PAID TO INSTORY IN THE PAST SIX MONTHS.

11. Indemnification

You agree to indemnify and hold InStory harmless from and against any claims, damages, or expenses (including attorneys' fees) arising out of your breach of these terms, misuse of the Service, or any infringement of third-party rights caused by your content.

12. Arbitration and Class Action Waiver

Any dispute related to InStory services shall be resolved through binding individual arbitration rather than in court. You and InStory both agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You have the right to opt out of this arbitration clause by contacting us within thirty (30) days of your initial registration.

13. Miscellaneous Provisions

These terms are governed by the laws of the Republic of Singapore. If any provision of this Agreement is held to be unenforceable, such provision shall be severed, and the validity of the remaining provisions shall not be affected. This Agreement constitutes the entire agreement between you and InStory regarding the use of the Service.

4. InStory 服务说明

InStory 是一款互动短剧应用。您观看的短剧会因您的选择而改变剧情走向、人物关系与结局，并且在剧情结束后您还可以继续与角色对话。InStory 保留随时修改、暂停或终止全部或部分服务的权利，无需另行通知。您同意，因服务被修改、暂停或终止，InStory 对您或任何第三方概不负责。为保证服务正常使用，您可能需不时更新应用或第三方软件。

与角色的对话由人工智能生成或辅助生成。您承认此类内容可能存在不完善或不准确之处，剧中角色均为虚构，InStory 不对 AI 生成内容的准确性或质量作任何保证。

5. 用户内容与许可

通过本服务提供的剧集、剧本、视频、角色与美术素材，归 InStory 或其许可方所有。在遵守本协议的前提下，我们授予您有限的、个人的、非排他的、不可转让且可撤销的许可，供您以非商业娱乐为目的进行播放和观看。未经我们事先书面许可，您不得下载、复制、再分发、公开表演或据此创作衍生作品。

您保留对您提供给本服务的内容的所有权，包括您做出的选择、您发送给角色的消息，以及您发布的评论或评分（统称“用户内容”）。通过使用本服务，您授予 InStory 一项永久、全球、免版税的许可，允许我们仅为运营、推广和改进服务（包括训练和优化我们的 AI 模型）而托管、使用及复制您的用户内容。

6. 用户行为准则与限制

您仅被允许出于合法且符合本协议的目的使用本服务。您同意不会：

• 使用本服务生成或分发任何非法、有害、辱骂、诽谤、淫秽或其他令人反感的内容。
• 尝试对服务的任何部分进行逆向工程、反编译或反汇编。
• 使用任何自动化系统（包括机器人、蜘蛛或爬虫）访问本网站或服务。
• 从事任何干扰或破坏服务或与服务相连的服务器和网络的活动。
• 录制、翻录、镜像或以其他方式再分发剧集内容，或使用本服务侵犯他人的知识产权。

7. 购买与订阅

部分剧集和功能仅通过应用内购买、金币包或付费订阅计划提供。通过订阅，您同意按周期提前支付所有适用费用。除非您在当前计费周期结束前取消计划，否则订阅将按原期限自动续订。除法律另有规定外，所有已支付费用均不予退还，金币等虚拟物品不具有现金价值。

通过 Google Play 商店或 Apple App Store 完成的购买，同时受相应应用商店条款（包括其退款政策）的约束。

8. 知识产权

本服务（包括其专有算法、图形界面及“外观和感觉”）受著作权法及商标法保护，且仍为 InStory 及其许可方的专属财产。InStory 的名称和标识是公司的商标，未经我们事先书面许可，不得使用。

9. 免责声明

您使用本服务的风险由您个人承担。本服务按“现状”和“现有”状态提供。InStory 不提供任何形式的明示或暗示保证，包括但不限于对适销性、特定用途的适用性及不侵权的暗示保证。

10. 责任限制

在法律允许的最大范围内，InStory 实体不对任何间接、偶然或结果性损害负责。InStory 因本协议项下的任何索赔而向您承担的总责任，不得超过 100 美元或您在过去六个月内向 InStory 支付的总额（以较高者为准）。

11. 补偿

您同意针对因您违反本条款、滥用服务或因您的内容导致任何第三方权利被侵犯而产生的任何索赔、损害或费用（包括律师费），向 InStory 进行补偿并使其免受损害。

12. 仲裁与集体诉讼豁免

任何与 InStory 服务相关的争议应通过具有约束力的个人仲裁解决，而非在法院审理。您与 InStory 均同意，任何争议解决程序仅以个人名义进行，不得以集体、合并或代表诉讼的形式进行。您有权在首次注册后的三十（30）天内联系我们选择退出此仲裁条款。

13. 其他规定

本条款受新加坡共和国法律管辖并按其解释。如果本协议的任何条款被裁定为不可执行，则该条款应被剔除，且不影响其余条款的有效性。本协议构成您与 InStory 之间关于使用本服务的完整协议。
